About these terms

These terms apply to your use of homeschoolinginportugal.com (the "site"), including the free guides and tools and the paid plans (the "service"). The service is provided by [Company name], NIF [NIF], with registered address at [Registered address], Portugal ("we", "us").

By creating an account or buying a plan, you accept these terms. Please also read our privacy policy, which explains how we handle personal data, and our legal notice.

Who can use the service

You can read the site without an account. To create an account you must be an adult (18 or over) and use the service as a parent or legal guardian, or with the authority of the child's parent or guardian, for the education of the children whose information you enter.

The service is offered to consumers for their family's use. If you want to use it for several families, for example as a tutor or learning community, contact us first.

Your account

You log in with a single-use link sent to your email address. We do not use passwords. You are responsible for keeping access to your email account secure, because anyone who can read your email can log in. Tell us straight away at hello@homeschoolinginportugal.com if you think someone else has accessed your account.

Keep your account details accurate. One account belongs to one household.

Plans and prices

Prices include VAT. VAT is calculated at the rate that applies to you, and the final price is shown before you pay.

Fair use. AI generation (for example annual plans, log mapping, sample tests and exercises) is subject to monthly limits per household that are shown in the app and on the pricing page. The limits are set so that normal family use is covered. If you reach a limit, the other features keep working and the limit resets at the start of the next period.

Exam Season Pass. The pass does not renew. It gives access until 31 July of the school year in which you buy it (the school year runs from 1 September to 31 August). A pass bought in August applies to the school year that starts on the following 1 September.

Free trial

The Family plan comes with a 14-day free trial. You do not need to give a card to start it. At the end of the trial your account returns to the free features unless you choose a paid plan. We do not charge you anything automatically after a trial.

Payment, renewal and cancellation

Payments are processed by Stripe. We do not see or store your full card details.

The Family plan renews automatically at the end of each monthly or yearly period, at the price in force at that time, until you cancel. We will remind you by email before a yearly renewal. If we change the price, we will tell you at least 30 days before the change applies to you, and you can cancel before it takes effect.

You can cancel at any time from the billing page in your account. Cancellation stops the next renewal. You keep access to the paid features until the end of the period you have already paid for. Except where the law gives you a right to a refund (see the next section), we do not refund partial periods.

After your paid access ends, your data stays in your account on the free plan until you delete it, so you can export it or subscribe again later.

Right of withdrawal

As a consumer in the European Union, you have the right to withdraw from a contract made online within 14 days, without giving a reason, under Decreto-Lei n.º 24/2014. The 14 days start on the day you buy the plan (not on the day you start a free trial).

The paid plans are digital services that start as soon as you pay. At checkout we ask you to:

1. expressly request that the service starts immediately, within the withdrawal period; and
2. acknowledge that, if you withdraw, you will pay for the part of the service provided up to the date you withdraw.

If you withdraw within 14 days, we refund what you paid, minus an amount proportional to the days of service you used before you told us. For example, if you withdraw after 5 days of a monthly plan, you pay for 5 days and we refund the rest.

To withdraw, write to hello@homeschoolinginportugal.com from the email address on your account, saying that you are withdrawing from the contract. You can also use the model withdrawal form provided by law, but you do not have to. We refund you within 14 days of receiving your request, using the same payment method.

The right of withdrawal applies to your first purchase of each plan. It does not apply again to automatic renewals of the same subscription, which you can cancel at any time as described above.

AI-generated content is a draft

The paid tools use AI to prepare drafts: annual plans, suggested curriculum links, portfolio texts, sample tests and exercises. These drafts are grounded in the official Aprendizagens Essenciais, but they can still contain mistakes, omissions or wording that does not fit your child or your school.

You are responsible for reviewing, editing and approving everything before you use it or send it to anyone. In particular:

• no document produced with the service is an official document;
• we do not guarantee that any school, tutor, agrupamento or authority will accept a plan, portfolio or other document you prepare with the service;
• sample tests are practice material. They follow the published format of official tests, but they are not official tests and do not predict results.

Not legal advice

The guides and tools give general information about the rules for home education in Portugal, with links to the official sources. They are not legal advice and do not replace advice from a lawyer about your situation. Schools and the competent authorities decide on each case. See our legal notice.

Acceptable use

When you use the service, you agree not to:

• enter or upload personal data about children or other people unless you are their parent or guardian or have the authority to do so;
• upload content that is unlawful, that infringes someone else's rights, or that contains malware;
• scrape, crawl or copy the site or the tools by automated means, beyond normal search-engine indexing;
• resell, sublicense or share access to a paid plan outside your household, or use the service to offer a commercial service to others without our written agreement;
• try to get around usage limits, access other households' data or interfere with the security or operation of the service;
• use the AI tools to generate content unrelated to your children's education.

We may suspend access if we reasonably believe these rules have been broken, and we will tell you why unless the law prevents it.

Intellectual property

Our content. The guides, texts, design, software, templates and the structure of our curriculum data belong to us or to our licensors. You may read, print and share the guides for personal and non-commercial use, and you may use the letter templates for your own correspondence. Any other reuse needs our permission.

Official texts. Laws, despachos, the Aprendizagens Essenciais and other official documents belong to their authors. Where we quote them, we do so in short extracts with attribution and a link to the official source.

Your content. You own what you create and upload: your plans, log entries, photos, portfolios and edits, and the documents you export. You give us a limited licence to store, process and display that content only to provide the service to you. This licence ends when you delete the content or your account, subject to the backup periods in our privacy policy.

Availability and changes to the service

We aim to keep the service available and working, but we do not promise it will be free of interruptions or errors. We may improve or change features. If we remove a paid feature that is a main part of your plan, we will tell you in advance, and if you cancel as a result you will receive a refund for the unused part of any period you have paid for.

Liability

Nothing in these terms limits your rights as a consumer under Portuguese and EU law, including your legal rights where digital content or a digital service is not in conformity with the contract.

As far as the law allows:

• we are not liable for decisions taken by schools, tutors or authorities, or for the consequences of using drafts you did not review;
• we are not liable for indirect losses, such as lost opportunities;
• our total liability to you in connection with the service is limited to the amount you paid us in the 12 months before the event that caused the claim.

These limits do not apply to liability for intent (dolo) or gross negligence, for death or personal injury, or to any other liability that cannot be excluded or limited by law.

Ending the contract

You can stop using the service and delete your account at any time from the settings page. Deleting your account deletes your data as described in our privacy policy. If you delete your account during a paid period, the subscription is cancelled; this does not affect your right of withdrawal.

We may end your account if you seriously or repeatedly break these terms. If we decide to close the service altogether, we will give you at least 30 days' notice so you can export your data, and we will refund the unused part of any period you have paid for.

Governing law and disputes

These terms are governed by Portuguese law. If you live in another EU country, you also keep the protection of the mandatory consumer rules of that country, and you can bring a claim in the courts where you live.

If you have a complaint, please write to us first at hello@homeschoolinginportugal.com. We will try to resolve it quickly.

Alternative dispute resolution. If we cannot agree, you can turn to a consumer dispute resolution entity (entidade de resolução alternativa de litígios de consumo). The entity competent for our registered address is [RAL entity name and website]. The full list of authorised entities is published at www.consumidor.gov.pt.

Complaints book. You can also submit a complaint through the online complaints book (Livro de Reclamações): www.livroreclamacoes.pt.

Changes to these terms

We may update these terms, for example when we change our plans or when the law changes. The date at the top shows the current version. If a change is to your disadvantage, we will tell account holders by email at least 30 days before it applies. If you do not agree, you can cancel before the change takes effect, and we will refund the unused part of any period you have paid for.
